Terms of Service

1. Acceptance of Terms

By installing, activating, or using the BoostBot plugin and its associated cloud service (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not install or use the Service.

These Terms constitute a legal agreement between you ("you" or "the site owner") and Boost Media Ltd. ("Boost Media," "we," "us," or "our"), a company registered in Israel.

2. Service Description

BoostBot is an AI-powered chatbot plugin for WordPress websites. The Service consists of two components:

• The WordPress Plugin (licensed under GPL v2 or later) — installed on your WordPress site, manages the chat widget, knowledge base, leads, analytics, and admin interface
• The BoostBot Cloud Service (proprietary) — hosted at boostbot.boostmedia.co.il, provides AI processing, credit management, and plugin updates

The plugin requires an active connection to the cloud service for AI-powered features to function. Without this connection, the chat widget will not appear on your site.

3. Account and Registration

• Your site is automatically registered with the BoostBot Cloud Service when you activate the plugin
• Each WordPress installation receives a unique site identifier and API key
• You are responsible for maintaining the security of your WordPress site and admin credentials
• One plugin installation corresponds to one site registration

4. BoostCoins (Credits)

AI features in BoostBot are powered by a credit system called BoostCoins:

• Free tier: Each new site registration receives 15 free BoostCoins (approximately 90+ conversations)
• Purchasing: Additional BoostCoins can be purchased through PayPal
• Usage: BoostCoins are consumed when visitors interact with the AI chatbot and when content is indexed for the knowledge base
• Non-transferable: BoostCoins are tied to your site registration and cannot be transferred to another site
• No expiration: Unused BoostCoins do not expire as long as your site remains registered
• Non-refundable: Consumed BoostCoins cannot be refunded. Refund requests for unused credits will be considered on a case-by-case basis

5. Acceptable Use

You agree not to:

• Use the Service to generate harmful, illegal, defamatory, or misleading content
• Attempt to circumvent or manipulate the credit metering system
• Reverse engineer, decompile, or disassemble the BoostBot Cloud Service
• Interfere with or disrupt the Service infrastructure
• Use the Service for spam, phishing, or distributing malicious content
• Resell or redistribute the cloud service without prior written authorization
• Exceed reasonable usage limits or abuse the free tier allocation

Violation of these terms may result in suspension or termination of your access to the Service.

6. AI-Generated Content

BoostBot uses third-party AI language models (Google Gemini, OpenAI GPT, and optionally Anthropic Claude) to generate chat responses. You acknowledge and agree that:

• AI-generated responses may not always be accurate, complete, or appropriate
• You are responsible for reviewing and managing the AI's behavior through the plugin's personality, rules, and forbidden topics settings
• We do not guarantee the accuracy or suitability of AI-generated content for any specific purpose
• Content generated by the AI in response to your visitors' queries belongs to you (the site owner)
• You are responsible for ensuring AI-generated content complies with applicable laws and regulations in your jurisdiction

7. Intellectual Property

• Plugin code: The BoostBot WordPress plugin is licensed under the GNU General Public License v2 or later. You may use, modify, and distribute the plugin code in accordance with the GPL.
• Cloud Service: The BoostBot Cloud Service, including its APIs, infrastructure, and proprietary algorithms, is owned by Boost Media Ltd. and is not covered by the GPL.
• Your content: Your site content, branding, and configuration data remain your intellectual property.
• AI outputs: Content generated by the AI through the Service belongs to you.

8. Third-Party Services

The Service relies on third-party providers for AI processing and payment handling. Your use of the Service is also subject to the terms and privacy policies of these providers:

• Google Terms of Service (Gemini AI, Google Calendar)
• OpenAI Terms of Use
• Anthropic Terms of Service (when Claude is selected)
• PayPal User Agreement

We are not responsible for the practices, terms, or availability of these third-party services.

9. Service Availability

• We strive to maintain high availability of the BoostBot Cloud Service but do not guarantee uninterrupted access
• We may perform scheduled or emergency maintenance that temporarily affects service availability
• If the cloud service is unreachable, the chat widget will gracefully hide from your site — your WordPress site will continue to function normally
• We are not liable for service interruptions caused by third-party providers, network issues, or events beyond our reasonable control

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Without limiting the foregoing, we do not warrant that:

• The Service will be error-free, secure, or uninterrupted
• AI-generated responses will be accurate, complete, or appropriate for your use case
• The Service will meet your specific requirements
• Defects in the Service will be corrected

11. Limitation of Liability

To the maximum extent permitted by applicable law, Boost Media Ltd. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, revenue, or business opportunities
• Loss of data or data breaches
• Damages arising from AI-generated content displayed to your visitors
• Service interruptions or downtime
• Actions or omissions of third-party service providers

Our total aggregate liability for all claims arising from or related to the Service shall not exceed the total amount you paid for BoostCoins in the twelve (12) months preceding the event giving rise to the claim.

12. Termination

• By you: You may stop using the Service at any time by deactivating and uninstalling the BoostBot plugin. Uninstallation removes all plugin data from your WordPress database.
• By us: We may suspend or terminate your access to the cloud service if you violate these Terms, abuse the system, or for any other reason at our discretion with reasonable notice.
• Effect of termination: Upon termination, your BoostCoin balance is forfeited. Local data in your WordPress database remains under your control.

13. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, store, and protect your data. By using the Service, you consent to the data practices described therein.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Updated Terms will be posted at this URL with an updated "Last updated" date. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms. For material changes, we will make reasonable efforts to notify you through the plugin admin panel or by email.

15. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the State of Israel, without regard to its conflict of law provisions. Any dispute arising from or related to these Terms or the Service shall be subject to the exclusive jurisdiction of the competent courts in Tel Aviv-Jaffa, Israel.
